These Terms and Conditions are intended to define the terms of availability and use of the site les-graphistes.fr (hereinafter "the Site"). The use of the Site implies full and complete acceptance of these conditions by the user.

3. Service Access

The Site allows illustrators (hereinafter "Members") to create an online portfolio to display their work. Access to the Site is free for any user with internet access. Equipment and connection fees are the responsibility of the user.

4. Account Creation and Services

• Creation: To publish a book, the user must create an account.
• Accuracy of information: The Member undertakes to provide real and up-to-date information.
• Plans: A free plan is offered by default. Paid "extended" options may be offered; pricing terms are specified upon subscription.
• Security: The Member is responsible for the confidentiality of their credentials.

5. Intellectual Property

• Copyright: The illustrator retains full intellectual property rights to their works.
• Display License: By publishing its content on the Site, the Member grants to the Publisher a non-exclusive and free license to display its works on the Site, solely for the purpose of promoting the Member's profile.
• Warranty: The Member guarantees that they are the original author of published content and possess all necessary rights to distribute it.

6. User Obligations

• Do not publish unlawful, hateful, defamatory content or content that violates public morals or third-party rights.
• Do not use the Site to send unsolicited advertising messages (spam).
• Do not scrape the Site data without prior authorization from the Publisher.

7. Publisher Responsibility

• Content: The Publisher acts as a host within the meaning of the law for trust in the digital economy and does not exercise prior control over published works. It reserves the right to delete any content reported as unlawful.
• Availability: The Publisher strives to ensure 24/7 access to the Site but cannot be held responsible for interruptions due to maintenance or technical issues related to the host.
• Relationship facilitation: The Publisher does not intervene in contractual relationships between illustrators and their potential clients.

8. Personal Data (GDPR)

• Rights: In accordance with GDPR, the User has the right to access, rectify and delete their personal data.
• Purpose: The collected data (name, email, images) are necessary for account management and portfolio display.
• Storage: Data is retained as long as the account is active.

9. Termination

The Member may delete their account at any time via their personal account or by simple email request. The Publisher may suspend or delete an account in case of non-compliance with these Terms and Conditions.

10. Applicable Law and Jurisdiction

These Terms and Conditions are governed by French law. In case of dispute and in the absence of an amicable settlement, the courts of Paris shall have sole jurisdiction.
